MEDICAL WAIVER

General Information

Medical information must be provided for your child to attend enrichment. It is essential for the program to have your child's current health information, in order to be able to ensure the safety and well-being of students during their time at KBCEF Programs.

Medical Waiver

WAIVER OF CLAIMS I, the undersigned, hereby certify that I am the parent or legal guardian of the participant. I hereby give permission for the staff of KCBCEF to seek appropriate medical/dental attention for the participant. I will be responsible for any and all costs of medical/dental attention and treatment. I the undersigned for ourselves, our heirs, executors, and administrators, waive, release, and forever discharge KBCEF, and its staff, officers, agents, employees, representatives, successors and assign of and form all rights and claims for damages, injuries, or loss to person or property which may be sustained or occur during participation in training activities, whether or not damages, injury, or loss is due to negligence. I hereby acknowledge that our child is physically fit and mentally capable of participating in enrichment activities.

TUITION POLICY

There will be no “tryout” classes. Transfers & Refunds will be only offered within 30 days of Enrichment. After that period, families will only receive a credit for future use. KBCEF reserves the right to cancel enrichment classes at any point during the semester and will refund a pro-rated portion of tuition.

LIABILITY RELEASE POLICY

IN CONSIDERATION of being permitted to utilize the facilities, services and programs of the KBCEF AND KEY BISCAYNE K-8 CENTER (or for my children to so participate) for any purpose, including, but not limited to observation or use of facilities or equipment, or participation in any off-site program affiliated with the KBCEF AND KEY BISCAYNE K-8 CENTER, the undersigned, for himself or herself and such participating children and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has, or immediately upon entering or participating will, inspect and carefully consider such premises and facilities or the affiliated program. It is further warranted that such entry into the KBCEF AND KEY BISCAYNE K-8 CENTER, for observation or use of any facilities or equipment or participation in such affiliated program constitutes an acknowledgment that such premises and all facilities and equipment thereon and such affiliated program have been inspected and carefully considered and that the undersigned finds and accepts same as being safe and reasonably suited for the purpose of such observation, use or participation by the undersigned and such children. 

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER THE KBCEF AND KEY BISCAYNE K-8 CENTER FOR ANY PURPOSE INCLUDING, BUT NOT LIMITED TO OBSERVATION OR USE OF FACILITIES OR EQUIPMENT, OR PARTICIPATION IN ANY OFF-SITE PROGRAM AFFILIATED WITH THE KBCEF AND KEY BISCAYNE K-8 CENTER, THE UNDERSIGNED HEREBY AGREES TO THE FOLLOWING: 

  1. THE UNDERSIGNED, ON HIS OR HER BEHALF AND BEHALF OF SUCH CHILDREN, HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the KBCEF AND KEY BISCAYNE K-8 CENTER, its directors, officers, employees, and agents (hereinafter referred to as “releases”) from all liability to the undersigned or such children and all his personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the undersigned, whether caused by the negligence of the releases or otherwise while the undersigned or such children is in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with the KBCEF AND KEY BISCAYNE K-8 CENTER. 
  2. THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releases and each of them from any loss, liability, damage or cost they may incur due to the presence of the undersigned or such children in, upon or about the KBCEF AND KEY BISCAYNE K-8 CENTER premises or in any way observing or using any facilities or equipment of the KBCEF AND KEY BISCAYNE K-8 CENTER or participating in any program affiliated with the KBCEF AND KEY BISCAYNE K-8 CENTER whether caused by the negligence of the releases or otherwise. 
  3. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE to the undersigned or such children due to negligence of releases or in, about or upon the premises of the KBCEF AND KEY BISCAYNE K-8 CENTER and/or while using the premises or any facilities or equipment thereon or otherwise while participating in any program affiliated with the KBCEF AND KEY BISCAYNE K-8 CENTER.
  4. THE UNDERSIGNED further expressly agrees that the foregoing RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of Florida and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. 

THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.

BEHAVIOR POLICY

The teachers and organizers reserve the right to withdraw a child from all classes. If the child has more than one written warning sent home in the current semester. Written warnings will be sent home if a child exhibits disruptive behavior in class. If the behavior is deemed unsafe, no warning is required. Bad behavior will not be tolerated! There are no refunds if the child is ejected from the program under the Behavior Clause.

MAKE-UP CLASSES POLICY

If any classes are cancelled due to unforeseen circumstances the instructor must make it up to the children/families. If the entire class semester is cancelled parents will have the option to transfer the student to a different class paying/receiving the difference in price accordingly.

Student absences due to illness (or otherwise) are non-refundable; KBCEF is not responsible in any way to provide financial reimbursement or substitute classes as a remedy for student absences from enrichment classes.

COMMUNICATION WITH TEACHER POLICY

It is the responsibility of the teacher and parent to communicate via phone or e-mail regarding any questions, issues or concerns.

PHOTO RELEASE POLICY

Use of any photos taken during KBCEF Enrichment classes is authorized for use by the parent/guardian/teacher/administrator in Key Biscayne K-8 Center yearbook as well as the KBCEF website and social media pages.

PERFORMANCE POLICY

All dances and drama students must be present for end of semester shows. It is the responsibility of the parent to obtain the show schedule dates from the instructor when available and keep students calendar for the shows.

PARENT/GUARDIAN PARTICIPATION POLICY

Parents/guardians are not authorized to select play roles and/or student characters in any or all of our Enrichment classes. Parents/guardians must treat instructors respectfully. Parents/guardians are not allowed to be present during Enrichment classes unless Instructor’s coordinated events such us end of the semester shows. They will be only allowed to drop off kids at class and pick them up timely at the door. It’s parents/guardians responsibility to sign out the student when class ends and they must show a photo ID at the door.

FORCE MAJEURE AND MAKE UP POLICIES

Neither party shall be responsible, nor incur any liability to the other for any failure to comply with the terms of this Agreement due to causes beyond its control, including, without limitation, fire storm, flood, acts of war, terrorism, accident, insurrection, sabotage, labor disputes, computer system malfunction, acts of God, acts of third parties, acts of federal, state or local government or judicial action (“force majeure”), provided that such actions that do not substantially hinder or prohibit performance will not excuse performance failure.

PAYMENT POLICY

We will be charging your credit card immediately upon registration. If payment is not provided the enrollment will be dropped.
